Step Out Please...

TABC = Texas Alcoholic Beverage Commission. Just thought I would translate that before I get started, since I am sure not all the readers are from Texas and wouldn’t know what TABC is. They are the liquor cops, and they are trying to justify their income same as anyone else. So now that I have that out of the way let’s pour a round and discuss.

So my preferred neighborhood establishment (the bar) was raided earlier this month by TABC. This isn’t a really big deal in and of itself, but the way the officers went about it is completely screwed up and illegal. Let me set the scene for you; you have an establishment that according to the fire marshal can be occupied by about 85 people, and generally only has about 20 people in it. At this establishment, being a local place, you have a number of regulars (15 of the usual 20). Not one of those places that are real high on the TABCs “Let’s raid it and get in the newspaper” list. But they did and they got in the newspaper, but not in a good way for them.

TABC along with a number of local police walked into the bar and began to request that the patrons step outside, of course being police types people did (dumb in my opinion) get up and move out to the front of the bar, where they were promptly tested and arrested for public intoxication. This, for those that are not familiar, is known as entrapment and is quite illegal in this country. Being in a bar people are, of course, drinking alcohol as is the purpose of being a licensed alcohol serving establishment. What the hell is going on that even in our over taxed, tired, trying to relax moments (not bothering anyone), there is some organization coming in to just completely fuck up your day? I mean I understand there is a purpose to TABC; they enforce things like “Don’t sell to minors”, but arresting a group of consenting hard working adults on a Friday for no particular reason except to justify income just seems wrong.

Well anyway it got in the paper; the city, county and State had to drop the charges “based on poor translation of intent” or some such shit. Basically they screwed up and can’t say it out loud. Grow a nut guys, say “I fucked up” and do better next time or get fired, whatever, as long as you are accountable for your actions instead of dodging the truth. Must be tough being a coward.

I don’t know… I don’t have much to say today, been a bad weekend (no I was not in the bar when that happened). As a closing thought, how about; Do your job and it will justify your income by its nature, you won’t have to generate an issue. If it doesn't then get a new job.

the police here would just join ur for a beer...

I looked into this and thats not true about the stepping outside. Inside the bar you can be charged with public intoxication inside the bar. Public is any place accessable to the public, your front lawn is a public place. Inside your house is not, a Garage with the garage door is accessable to the public. If you think about it, it makes sense. Still sux but it's the way it is.

yep you are right mouse, but it's a recent change as I understand it... I was not aware of taht change untill a few days ago so my bad for the ignorance.. it's still fucked up.
